Orphan Drug Status for RPI-78M Boosts Nutra Pharma Corp.’s (NPHC) IP Portfolio

Last September’s award of orphan drug status to Nutra Pharma Corporation (OTCQB: NPHC) for RPI-78M for the treatment of Juvenile or Pediatric Multiple Sclerosis was a significant milestone on the company’s road to success as a speculative bio-pharmaceutical company. In an interview (http://dtn.fm/7jXjw) with Stock News Now, CEO Rik Deitsch called the award “the most substantial event in the history of our drug discovery efforts,” but went on to lament that, ironically, the company had been hobbled by its own success.

Although essentially focused on drug discovery, Nutra Pharma markets an over-the-counter (OTC) line of homeopathic remedies. This includes Cobroxin, the first over-the-counter (OTC) pain reliever clinically proven to treat moderate to severe (Stage 2) chronic pain; Nyloxin and Nyloxin Extra Strength. The latter two are the only non-narcotic and non-addictive treatments for severe (Stage 3) pain. Both Cobroxin and Nyloxin were developed by Nutra Pharma’s wholly-owned drug discovery subsidiary, ReceptoPharm, but these OTC remedies put out by Nutra Pharma have attained more marketing visibility and overshadowed its intellectual property (IP) pipeline. Nevertheless, Cobroxin and Nyloxin are just the tip of the Nutra Pharma iceberg. The company holds 21 patents on treatments for myasthenia gravis (MG), juvenile multiple sclerosis (MS), adrenomyeloneuropathy (AMN), human immunodeficiency virus (HIV) and pain. These, Deitsch explains, are the “blood… the genetics of the company.”

Nutra Pharma’s approach to the treatment of Pediatric Multiple Sclerosis (PMS), so called because it refers to sufferers under the age of 16, is a novel one. At present, PMS is treated with immunosuppressive drugs that can only slow the progression of the disease. Based on clinical studies of RPI-78M, Nutra Pharma expects RPI-78M may have the potential to not only stop further development of the disease but reverse its symptoms. Deitsch has speculated, “If we can get the drug through Phase I and Phase II trials, we plan to license it to a large pharma partner. We expect it to change the way we treat autoimmune diseases.”

Orphan Status for a drug brings many advantages. It gives the sponsoring company tax credits that may amount to as much as 50% of the development costs attributable to qualified clinical testing. This could include remuneration to employees to supervise, carry out and support qualified clinical testing activities. Orphan Status can also mean a reduction or exemption from FDA fees. Under various statutes, beginning with the Prescription Drug User Fee Act of 1992 (PDUFA I), the FDA is authorized to assess user and application fees, but it can grant a waiver or deduction of these fees if ‘A waiver or reduction is necessary to protect the public health OR the assessment of the fee would present a significant barrier to innovation because of limited resources available to the person or other circumstances OR the applicant is a small business submitting its first human drug application… for review.’

That’s not all; Orphan Drug status allows a sponsor exclusive marketing rights for a limited period. Orphan Drug Exclusivity (ODE) is typically for a period of 7 years. After it’s granted, the FDA may not approve applications for generic or second innovator products that contain the same active ingredient and are labeled for the same orphan indication.

Nutra Pharma may be helping sufferers of chronic pain mitigate their discomfort, but it’s a company that aims to do a lot more than that. Earlier this year, it announced it had also applied for Orphan Status for its RPI-78M treatment for MG.

In a recent letter to shareholders, Deitsch said, “It is our goal to complete the Phase I/II trials in pediatric MS over the next 18 months and then either move into Phase III trials or seek a licensing partner. As we have always stated, it is our eventual goal over the next several years to market or license our drugs for the treatment of Multiple Sclerosis and HIV/AIDS. Nutra Pharma Corporation (NPHC) Leaning on Revenues Derived from Proven Over-the-Counter Drugs to Fund Development Pipeline

“We started speaking with the FDA in 2009 about an ethical pain therapy that uses microgram doses of cobra venom extract as a neurotoxin, or neuro blocker, for pain and inflammation,” Deitsch recounted in the article. “The FDA told us our drug qualified as an OTC homeopathic medication because it is derived from a natural product and because the dosage is so small. That allowed us to create our first OTC drugs in 2009–2010.”

To date, Nutra Pharma has released seven unique stock keeping units (SKUs) of Nyloxin, which is an OTC pain treatment for humans, as well as one SKU of Pet Pain-Away for dogs and cats. Products under both of these brands leverage a non-addictive, non-narcotic formula and lack all of the negative side effects commonly associated with other OTC pain medications. Despite this stellar safety profile, Nyloxin has shown to be approximately 600 times more potent than morphine in clinical studies, offering pain relief for roughly four hours longer than the popular opioid medication.

In the Life Sciences Report article, Deitsch noted that Nutra Pharma is “at an inflection point.” Because it is able to generate significant revenues from OTC drug sales – with sales from these products expected to increase dramatically over the next 16 months, according to Deitsch – the company has effectively mitigated the risk to investors while continuing to push forward with clinical trials for a pipeline of potential blockbuster drugs addressing underserved indications such as multiple sclerosis (MS), human immunodeficiency virus (HIV), and select autoimmune and antiviral conditions. Deitsch predicts that Nutra Pharma will be cash-flow positive within the first half of 2016.

The Orphan Drug Act was passed by Congress in 1983 to encourage research and development of treatments for rare diseases. An orphan drug is a drug intended to treat a condition affecting fewer than 200,000 persons in the United States, or which will not be profitable within 7 years following approval by the FDA. Orphan status and FDA approval are not the same thing. Orphan status does not mean that the FDA has approved the drug.

The right to marketing exclusivity is a valuable one, as Martin Shkreli and Turing Pharmaceuticals have shown. An enlightening article (http://dtn.fm/4bKpR) in Science Translational Medicine tells the amazing saga of Daraprim, or pyrimethamine. The drug was approved by the FDA back in 1953 and manufactured by GlaxoSmithKline (NYSE: GSK), which disposed of its U.S. marketing rights to CorePharma in 2010. CorePharma was later acquired by Impax, which sold Daraprim to Turing for $55 million. In the GlaxoSmithKline days, Daraprim went for about $1 per tablet. After its acquisition by CorePharma, it was selling for around $10 per tablet. Now, Shkreli has appeared before Congress to explain Turing’s decision to raise the price from $13 to $750.

Nutra Pharm has also applied (in December 2015) for Orphan Status for its RPI-78M treatment of myasthenia gravis (MG). In addition, receiving orphan status for RPI-78M brings a number of bonuses for Nutra Pharma. Not only does orphan status give the company a fast track at the FDA, it gives it the ears of the FDA and rolling review. It gives it access to grants and collaborative research agreements, and, in a relatively recent change, once a company has an approved orphaned drug, it may be able to receive an orphan drug voucher, which allows it to get a second drug approved and still have the benefits of orphan status. A few months later, Biomarin announced it had sold its voucher to Sanofi and Regeneron for $67.5 million. Nutra Pharma Corp. (NPHC) is fighting for Myasthenia Gravis Sufferers with its Orphan Drug Application for RPI-78M

Nutra Pharma Corp. (OTCQB: NPHC) hasn’t forgotten about the sufferers of myasthenia gravis (MG). The Coral Springs, Florida-based company announced in December 2015 that it had applied for Orphan Status from the Food and Drug Administration (FDA) for its RPI-78M treatment for MG. RPI-78M, described as modified a-cobra toxin in the FDA Orphan Drug database, has already been granted Orphan Status for the treatment of pediatric multiple sclerosis for sufferers up to the age of 16.

Under the Orphan Drug Act of 1983, a drug to treat a ‘rare disease or condition’ can be granted special status referred to as Orphan Designation or, alternatively, Orphan Status. A ‘rare disease or condition’ is one that, generally, affects ‘less than 200,000 persons in the United States’ or ‘affects more than 200,000 in the United States and for which there is no reasonable expectation that the cost of developing and making available in the United States a drug for such disease or condition will be recovered from sales in the United States… within 7 years’. In addition, Orphan Status gives access to incentives that include 7-year marketing exclusivity, tax credits (up to 50% of clinical development costs), an exemption/waiver of application fees and general assistance from the Office of Orphan Products Development (OOPD), an agency of the FDA. Although Orphan Status for a drug is not a requirement, developers of Orphan Status drugs may also be awarded grants under the Orphan Products Grants Program.

According to the U.S. National Library of Medicine’s PubMed Health portal, ‘Myasthenia gravis is a rare autoimmune condition in which antibodies produced by the immune system attack the connection between nerves and muscles (the neuromuscular junction). Nerve impulses become blocked, causing muscles to become weak and easily tired. Symptoms fluctuate in severity. Acetylcholine is a chemical messenger that carries signals between nerve and muscle. An enzyme called acetyl-cholinesterase breaks down acetylcholine. Some drugs that are used to treat myasthenia gravis act on acetyl-cholinesterase to stop the breakdown of acetylcholine. These acetyl-cholinesterase inhibitors increase the amount of acetylcholine available and so help muscle activation and contraction.’ Consequently, cholinesterase inhibitors enhance communication between muscles and nerves and may improve muscle contraction and muscle strength.

With RPI-78M, Nutra Pharma is taking a different approach. RPI-78M contains anti-cholinergic peptides that recognize the same receptors as nicotine (acetylcholine receptors) but have the opposite effect. In other words, an anti-cholinergic drug like RPI-78M has the opposite pharmacological action to a cholinesterase inhibitor. An anti-cholinergic works by blocking the action of the neurotransmitter acetylcholine in the brain and so stops involuntary movements of the muscles associated with these diseases.

Nutra Pharma Corp. (NPHC) Applies for Additional Orphan Drug Designation for RPI-78M

Nutra Pharma Corp., a biotechnology company marketing Nyloxin® and Pet Pain-Away in the over-the-counter (OTC) pain management market, as well as developing treatments for multiple sclerosis (MS), human immunodeficiency virus (HIV), adrenomyeloneuropathy (AMN) and pain, announced today that it has applied for an Orphan Drug designation from the U.S.-FDA for the Company’s RPI-78M drug candidate for the treatment of myasthenia gravis (MG). In September 2015, Nutra Pharma was granted an Orphan Designation for this drug candidate for the treatment of pediatric MS.

“We have been clear over the last year that we would be moving our drug platforms forward,” stated Rik J Deitsch, chairman and CEO of Nutra Pharma. “This includes our work in pediatric multiple sclerosis, as well as additional potential Orphan Designations for our therapeutic pipeline. We expect to receive the Orphan Designation for MG. In the meantime, we will continue to work with our FDA consultants to prepare for an Investigative New Drug Application as we develop the clinical trial protocols for pediatric MS.”

For those unfamiliar with MG, it is a chronic autoimmune neuromuscular disease characterized by varying degrees of weakness of the skeletal (voluntary) muscles of the body. The name “myasthenia gravis” literally means “grave muscle weakness.” MG is known for causing muscle weakness that increases during periods of activity and improves after periods of rest. Certain muscles, such as those that control eye and eyelid movement, facial expression, chewing, talking and swallowing, are often, but not always, involved in the disorder. The muscles that control breathing and neck and limb movements may also be affected. RPI-78M is believed to be effective in the treatment of MG through the modulation of the immune system, preventing autoimmune effects.

By receiving Orphan Drug status, Nutra Pharma would benefit from a seven-year period of market exclusivity in the U.S. upon approval of the drug, as well as tax credits for clinical research costs, the ability to apply for grant funding, clinical trial design assistance, assistance from the FDA in the drug development process, and the waiver of Prescription Drug User Fee Act (PDUFA) filing fees, which could be in excess of $2.5 million. It also allows the company to move forward with its preparation of an Investigative New Drug Application and proposal of clinical trials. The FDA grants Orphan Drug Designation status to products that treat rare diseases, providing incentives to sponsors developing drugs or biologics. The Orphan Drug Act of 1983 is intended to assist and encourage companies to develop safe and effective therapies for the treatment of rare diseases and disorders, defined as those affecting fewer than 200,000 Americans at any given time.

Originally derived from an extract of cobra venom, RPI-78M is an antagonist of the nicotinic acetylcholine receptor. The drug has an unusually low toxicity with a very large therapeutic window. Scientific publications have shown that native and modified neurotoxins can protect nerve cells from early cell death. Also, RPI-78M may be beneficial in neuromuscular disorders where the activity of nicotinic acetylcholine receptor has been compromised. The proprietary technology is covered by patents describing the application and use of RPI-78M in the treatment of autoimmune diseases.

Nutra Pharma Corp. (NPHC) is “One to Watch”

Nutra Pharma Corp. is a biotech company working in collaboration with its subsidiaries to develop an innovative pipeline of biopharmaceutical products for the management of neurological disorders, cancer, autoimmune, and infectious diseases. ReceptoPharm holds all of the intellectual property for Nutra Pharma’s drug pipeline, while Nutra Pharma directly holds all of the property dealing with their over-the-counter drugs. This includes Nyloxin, an OTC pain reliever for humans, and Pet Pain-Away, a pain reliever for dogs and cats. The company’s Nyloxin product is the first OTC pain reliever clinically proven to treat moderate to severe chronic pain. The drug is available as an oral spray for treating lower back pain, migraines, neck aches, shoulder pain, cramps and neuralgia and as a topical gel for treating joint pain and pain associated with repetitive stress and arthritis.

Nutra Pharma is a revenue-generating company with 12 patents and patents pending, three completed phase 1/phase 2 clinical trials, and 12 FDA-registered OTC products in the United States. The company also has regulatory clearance for Nyloxin in India, where management believes its initial distribution streams could become the company’s biggest market. Management is also defining its plan to expand into China and Canada while strengthening its position the United States.
